Notice of Delisting or Failure to Satisfy a Continued Listing Rule or Standard;
On August 31, 2009, World Heart Corporation (the "Company") received a NASDAQ Staff Deficiency Letter indicating that the Company does not comply with NASDAQ Listing Rule 5550(a)(4). This rule requires the Company to maintain a minimum of 500,000 publicly held shares for continued listing on the NASDAQ Capital Market. Subsequently, on September 4, 2009, the Company received a letter from the NASDAQ Staff stating that the Company has regained compliance with Listing Rule 5550(a)(4) and that this matter is now closed.
