(e) On July 13, 2009, The Timberland Company (the "Company") announced that Eugene R. McCarthy, formerly Co-President - Timberland Brand, would leave the Company effective July 17, 2009. In addition to amounts due to Mr. McCarthy under his existing arrangements with the Company, Mr. McCarthy and the Company have entered into a separation agreement providing for a cash separation payment in the amount of $345,019. Following Mr. McCarthy's departure, the Company announced internally on July 22, 2009 that Michael J. Harrison's title as Co-President - Timberland Brand will be changed to Chief Brand Officer.
