On June 1, 2009, Vitesse Semiconductor Corporation (the "Company") issued a press release announcing the pending resolution of the previously announced investigation by the Securities and Exchange Commission into the Company's historical stock option practices and certain other accounting irregularities. A copy of such press release is attached hereto as Exhibit 99.1.
